The ultimate goal of understanding PERM Ad Requirements is of course a successful Labor Certification, like in the email below.
For the petition to be Certified, the “mandatory” and “additional” recruitment ads must pass the review of a Certifying Officer.
And to do that, they have to comply. The regulations spell out how to accomplish this, -but as they are written, it may be difficult for a first time filer, be it a paralegal, new attorney, or someone who’s just never done it before.
PERM Ad requirements, basically stated, are that you need to run it for 2 Sundays in the newspaper of General Circulation.
For example,
In Orange County, this can actually be the Los Angeles Times Orange County Edition.
Many items get run in the more expensive Orange County Register, but the OC Edition of LA Times has been accepted for years by Certifying Officers for ads in OC. A price difference of $400-500.
This is because DOL accepts the paper complies with PERM ad requirements for coverage, etc.
An example is on the left, -it contains the job title, job location, sufficient description of duties, educational and experience requirements, and a proper way to apply for the job.
This only cost the employer about $400 to run on 2 Sundays. Not bad. They’re lucky to be in Orange County. In Dallas, San Jose, or even Oakland, might be much more.
This brings up a critical point: Saving money should not be the primary objective. After all, this is for a Green Card.
PERM ad requirements should be the focus. Trim the text if you must, but keep it compliant.
SWA Job Order:
The next order of business is of course the 30 Day Posting on the relevant State Workforce Agency site.
It’s known by many names, each state in the union has a different departmental name for them, -and navigating to the websites can often be a test of wits. Click here for our listing of all SWA’s.
The language in this posting can be much more elaborate, as it contributes to further adherence to regulations. It demonstrates a good-faith effort, a concept that is built into the review process.
It can fully describe all the relevant job duties without abbreviation.
The same can be said for an Employer Website Job Posting, which we can do for as low as $130 in less than an hour.
The rest of them can follow a similar design, with radio of course being converted to spoken word, and again, minimized similar to the newspaper.
