SWA Employer Registration:
If the Petitioner (Employer) already has a SWA account, great. If they don’t, they’ll need to register for an Employer account on the relevant state site. Here’s a list of all State Workforce Authority sites.
Basic information required is usually as follows:
- FEIN
- UI#
- Business Name
- Address
- Phone
You can expect SWA registrations to be interrupted by the official vetting process, and the fact each State does it differently from month to month depending on their staff training or policy changes. SWA Job Order Posting:
Once the Petitioner’s employer account is active on the SWA site, posting a Job Order is straightforward.
The ad text can be longer than used in print ads. But it should be very close to what was used in the Prevailing Wage Determination. The education and experience requirements should not be different than what was indicated in the PWD.
When the Job Order is active, it can be documented by creating a PDF printout of it, on the first day it runs. The same applies for the end date.
Some attorneys prefer to assure that a SWA Job Order is active before advising the Petitioner to run the print ads and other recruitment methods. This assures that if there is a problem with SWA registration or account verification, that the print ads were not bought in vain.
DOL PLC ETA Online Registration:
Online registration with the Department of Labor PLC ETA Online system is a common procedure to PERM Recruitment.
