Introduction:
Below you’ll see the section 17 of the Code Of Federal Regulations CFR 656, stating the requirement to file a SWA Job Order.
This page simply acts as a guide for how to navigate to the State’s site. In this case it’s the California State Workforce Authority. The official name for this agency in California is the CALJOBS and it’s job postings website is here: Employer Workspace.
Dept Of Labor & Code Of Federal PERM Regulations:
(i) Mandatory steps. Two of the steps, a job order and two print advertisements, are mandatory for all applications involving professional occupations, except applications for college or university teachers selected in a competitive selection and recruitment process as provided in §. The mandatory recruitment steps must be conducted at least 30 days, but no more than 180 days, before the filing of the application.
(A) Job order. Placement of a job order with the SWA serving the area of intended employment for a period of 30 days. The start and end dates of the job order entered on the application shall serve as documentation of this step.
(B) Advertisements in newspaper or professional journals. Placing an advertisement on two different Sundays in the newspaper of general circulation in the area of intended employment most appropriate to the occupation and the workers likely to apply for the job opportunity and most likely to bring responses from able, willing, qualified, and available U.S. workers.
Specific info for the California State Workforce Authority (SWA):
The State of California SWA Job Order system is accessed through a site called CALJOBS, which you can access here.
Compared to most states, it has a very simple interface, allowing Employers to register for an online account. Once this account is approved and active, one can post a California SWA Job Order for 30 days per the PERM Labor Certification guidelines set forth in CFR Part 656.17.
PERM-Ads.com offers the service of assisting & documenting California SWA Job Orders. We do not charge for the registration or job posting work, as that must remain free by state law. Our fee covers the coordination, documentation and production of evidential printouts used in the filing of a DOL Form 9089.
We recommend you first use the California SWA Job Order site run by EDD, as it’s actually very simple and straightforward. Only attorneys and employers who decide in concert to use our service need apply.
