What is an EDD Number?

An EDD Customer Account Number is the 10-digit state unemployment insurance identification number that the Employment Development Department of California assigns to a company.

It can be used to register for UI Online services.

It can also be used to register an employer account on the EDD CalJobs website for the purposes of filing mandatory State Workforce Authority SWA Job Orders in compliance with CFR 656.17 PERM Labor Certification guidelines.

How do I register for an EDD Number?

To register for an EDD Number (in California) use this link:  https://www.edd.ca.gov/payroll_taxes/e-Services_for_Business.htm

How do I find my company’s EDD Number?

Per the EDD do as follows:

All Unemployment Insurance customers who file a new claim will automatically receive their Employment Development Department (EDD) Customer Account Number (DE 5614) letter within 10 business days of filing.

If you have lost, misplaced, or never received your EDD Customer Account Number, contact the EDD:

By Phone: Call 1-800-300-5616 from 8 a.m. to 8 p.m. (Pacific time), seven days a week.

Online: Go to Ask EDD and select the category Unemployment Insurance Benefits, the sub category UI Online, and the topic EDD Customer Account Number.

Select Continue at the bottom of the page to begin the process of submitting your message.

Why do I need an EDD Number for PERM Recruitment?

It’s necessary for PERM Recruitment to satisfy the CFR 656.17 requirement to post a Job Order on the appropriate State Workforce Authority online website.

For filings where the jobsite is in California, that means the Petitioner / Employer must register on the EDD CalJobs website. This requires an EDD Number. This registration is additional to the registration for an EDD Number. CalJobs is a standalone site just for SWA Job Orders.

DOL implements Foreign Labor Application Gateway (FLAG) System for PERM Prevailing Wage Requests

Introducing Foreign Labor Application Gateway (FLAG):

On June 10, 2019, DOL implemented it’s new Foreign Labor Application Gateway (FLAG) System for PERM Prevailing Wage Requests.

In their own words on the site’s home page, DOL states:

The Foreign Labor Application Gateway (FLAG) is a cloud-based portal designed to replace OFLC’s current iCERT System and will serve as the new application filing and case management solution for all foreign labor certification programs.

So this means that indeed iCERT is being phased out.

As of June 10th, 2019, ALL new Prevailing Wage Determinations must now be submitted through the Foreign Labor Application Gateway (FLAG) system.

H-1B FLAG Filing Options:

The system now also allows for electronic filing for the H-1B, H-1B1, and E-3 programs via ETA-9035 online application forms.

H-2A FLAG Filing Options:

DOL Foreign Labor Application Gateway (FLAG) Sign Up:

The actual procedure for using the system involves first creating a login account for yourself at the LOGIN.GOV website.

This is a much better improvement on security as login authentication if managed by a central tool that can interact with multiple agency portals. This translates to you, the client, having fewer government agency logins and passwords to manage.

With today’s introduction (or re-introduction, really) of two immigration-related bills in the house, it is becoming clearer that President Obama’s stated intent to address comprehensive immigration reform this year is serious.

The first piece, the reintroduced Agricultural Job Opportunities, Benefits and Security Act, or AgJOBS, presents revised immigration policy aimed at changing the relationship between Ag and farm employers and their temporary or permanent immigrant workers.

The second, the DREAM Act, first introduced in 2007, is focused on immigrant students, high-school and college, who came to the US when they were younger than 16, and have now graduated high-school and either some college or two years of military service.

It provides a path to permanent residence, and eventually, citizenship.

Both bills were reintroduced in both the Senate and the House, and both have sufficient co-sponsorship that they are viewed as having broad bipartisan support.
